Terms of Service

1. Agreement Overview

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services provided by Arc Sentinel SRL ("Arc Sentinel", "we", "us"), including the Quest Guardian child safety platform, the Quest Guardian Shield desktop application, and all associated websites (arcsentinel.tech, questguardian.tech, app.questguardian.tech, get.questguardian.tech).

By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Eligibility

• You must be at least 18 years of age to create an Arc Sentinel account
• You must be a parent or legal guardian of any children whose profiles you create in Quest Guardian
• You are responsible for ensuring that your use of Quest Guardian complies with applicable laws in your jurisdiction, including laws related to monitoring minors' digital communications
• Quest Guardian is intended for parental monitoring of minor children; use for monitoring adults or non-dependents is prohibited

3. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and encryption keys
• Immediately notify us of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

Encryption key responsibility: Quest Guardian uses a privacy-first architecture where you hold the encryption keys for your children's monitoring data. If you lose your encryption keys and recovery passphrase, we cannot recover your encrypted data. We strongly recommend securely storing your recovery passphrase.

4. Service Description

4.1 Quest Guardian Platform

Quest Guardian is a child safety platform that monitors gaming communications to detect harmful content and malicious actors. The platform consists of:

• Shield (desktop application): Installed on the child's device to capture and encrypt monitoring data
• Parent Dashboard (web application): Allows parents to view alerts, manage settings, and review encrypted evidence
• Mobile App: Provides push notification alerts and basic dashboard access on mobile devices
• Backend API: Manages authentication, alert routing, and encrypted data storage

4.2 Decentralized AI Processing

Safety classification of monitoring data is performed on decentralized AI infrastructure (Ratio1.ai network), not on centralized cloud servers. This means processing availability depends on network capacity. We implement queue-based systems and pre-filtering to manage capacity but cannot guarantee real-time processing at all times.

4.3 Service Limitations

Quest Guardian is a supplementary safety tool. It does not:

• Replace parental supervision or open communication with children
• Guarantee detection of all harmful content or malicious actors
• Provide content filtering or blocking (it monitors and alerts, it does not censor)
• Monitor end-to-end encrypted communications within third-party platforms that prevent external observation

5. Subscription Tiers & Billing

Quest Guardian offers multiple subscription tiers (Free, Guardian, Sentinel, Enterprise) with varying feature levels. Details of current pricing and feature inclusions are available on our product website.

• Free tier is available with limited functionality (1 device, 1 child profile, 24-hour evidence retention)
• Paid subscriptions are billed monthly or annually, as selected at purchase
• You may cancel your subscription at any time; access continues through the end of the current billing period
• Refund requests are handled on a case-by-case basis within 14 days of purchase, in compliance with EU consumer protection directives

6. Acceptable Use

You agree not to:

• Use Quest Guardian to monitor any person who is not your minor child or legal dependent
• Attempt to reverse-engineer, decompile, or extract source code from the Shield application
• Interfere with or disrupt our services or infrastructure
• Use our APIs or services in a manner that exceeds reasonable usage limits
• Resell, sublicense, or redistribute access to our services without authorization
• Use our services for any purpose that violates applicable laws or regulations

7. Intellectual Property

All intellectual property rights in Quest Guardian, Shield, our websites, documentation, APIs, and related materials are owned by Arc Sentinel. These Terms do not grant you any rights to our trademarks, logos, or branding.

You retain ownership of all data you provide through the platform, including child profile information and monitoring configuration. Encrypted monitoring content belongs to you (the parent) as the keyholder.

8. Privacy & Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using our services, you acknowledge that you have read and understood our Privacy Policy.

9. Disclaimers

Quest Guardian is provided "as is" and "as available." To the maximum extent permitted by applicable law:

• We make no warranties regarding the accuracy, reliability, or completeness of safety detections
• We do not warrant uninterrupted, error-free, or secure operation of our services
• AI-based safety classification may produce false positives or miss genuine threats
• Decentralized processing depends on network availability and is not guaranteed to be instantaneous

These disclaimers do not affect your statutory rights as a consumer under EU or Romanian law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Arc Sentinel shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to:

• Failure to detect harmful content or malicious actors
• Loss of encrypted data due to lost encryption keys
• Service interruptions or downtime
• Actions taken (or not taken) based on alerts or information from our platform

Our total liability for any claim arising from these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim. Nothing in these Terms limits our liability for fraud, gross negligence, or any other liability that cannot be excluded by law.

11. Termination

You may terminate your account at any time through the parent dashboard settings. Upon termination:

• Your account and all associated data will be scheduled for deletion
• Encrypted evidence will be permanently deleted per our retention schedule
• Account deletion is completed within 30 days
• You may request a data export before termination (GDPR right to portability)

We may suspend or terminate your account if you violate these Terms, with notice where practicable.

12. Governing Law & Disputes

These Terms are governed by the laws of Romania and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bucharest, Romania, except where EU consumer protection law provides otherwise.

EU consumers have the right to bring proceedings in their country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Your continued use of our services after the effective date constitutes acceptance of the revised Terms.
